Terms of service

Terms of Service

These Terms of Service apply when you use the HAMYNAT website or purchase products from us.

By placing an order with HAMYNAT, you agree to these terms together with our Refund & Returns Policy, Shipping & Delivery Policy and Privacy Policy.

Nothing in these terms affects your statutory rights under UK consumer law.

1. About HAMYNAT

HAMYNAT is operated by HAMYNAT LTD, a company registered in England and Wales.

Our company registration details, business contact information and VAT information, where applicable, are provided on our website and/or order documentation.

2. Our Products

We specialise in beauty, body-care, fragrance and personal-care products.

We aim to ensure that product descriptions, photographs, sizes, fragrances, ingredients and other information displayed on our website are accurate.

However, product packaging, labels, colours or presentation may occasionally change where manufacturers update their products.

Images are provided for illustration and product identification. Colours may also appear slightly different depending on your screen or device.

Where a manufacturer changes packaging without changing the underlying product, you may receive the updated packaging.

If a change materially affects the product you ordered, your statutory rights remain unaffected.

3. Ingredients & Product Information

Where available, ingredient information is provided to help customers make informed purchasing decisions.

Manufacturers may occasionally reformulate products. If you have an allergy, sensitivity or specific ingredient concern, we recommend checking the ingredient list shown on the physical product before use.

Please discontinue use if you experience an adverse reaction.

Nothing in these terms limits your rights where a product is faulty, unsafe, incorrectly labelled or not as described.

4. Placing an Order

Products displayed on our website are an invitation for customers to place an order.

When you submit an order, you are offering to purchase the products in your basket.

After placing your order, you may receive an automated order acknowledgement confirming that we have received it.

Unless we tell you otherwise, this acknowledgement does not mean that we have accepted your order.

Our acceptance of your order takes place when we dispatch the goods and send you confirmation of dispatch.

At that point, a contract for the products dispatched is formed between you and HAMYNAT.

5. Our Right to Decline or Cancel an Order

Before an order has been accepted, we may decline or cancel it where reasonably necessary.

Examples may include:

  • an item becoming unavailable;

  • an obvious pricing or listing error;

  • incorrect product information;

  • problems authorising payment;

  • suspected fraudulent or unauthorised transactions;

  • suspected misuse of promotions or discount codes;

  • quantities that appear inconsistent with normal consumer purchasing;

  • restrictions affecting our ability to deliver the order; or

  • another genuine operational or legal reason preventing us from fulfilling the order.

If we cancel an order after payment has been taken, any amount due back to you will be refunded to the original payment method.

We will not cancel orders arbitrarily or use this provision in a way that unfairly restricts a customer's statutory rights.

6. Prices

All prices are shown in the currency displayed on the website.

Prices may change from time to time, but changes will not normally affect an order that we have already accepted.

Applicable delivery charges will be displayed during checkout before you place your order.

We take reasonable care to ensure prices are correct.

If an obvious pricing error occurs, we may contact you before accepting the order and give you the option of purchasing at the correct price or cancelling the order.

We are not obliged to accept an order at an obviously incorrect price where the error could reasonably have been recognised as a mistake.

7. Promotions, Discount Codes & Offers

From time to time, HAMYNAT may offer sales, promotional prices, discount codes, bundles, free gifts or other special offers.

Unless otherwise stated:

  • promotions are subject to availability;

  • promotional codes cannot be exchanged for cash;

  • only one promotional code may be used per order where specified;

  • promotions may have qualifying products, minimum spends or expiry dates; and

  • promotions cannot be applied retrospectively to completed purchases.

Where a promotion has specific terms, those terms will be displayed with the offer.

We reserve the right to withdraw or correct a promotion where there has been a genuine error or misuse.

Your statutory consumer rights are not affected by purchasing an item during a promotion or sale.

8. Availability

All products are subject to availability.

Adding a product to your basket does not reserve it.

On rare occasions, an item may become unavailable after an order has been placed.

If we cannot supply an item, we will contact you where appropriate and refund any amount paid for the unavailable item.

We will not substitute a materially different product without your agreement.

9. Payment

Payment must be made using one of the payment methods offered at checkout.

By submitting payment details, you confirm that you are authorised to use the selected payment method.

Orders may be subject to payment verification and fraud-prevention checks.

10. Delivery

Delivery options, charges and estimated delivery times are displayed during checkout where applicable.

Please ensure that the delivery information you provide is accurate and complete.

Full information about dispatch, tracking, incorrect addresses, failed deliveries, missing parcels and delivery investigations can be found in our Shipping & Delivery Policy.

11. Returns, Refunds & Cancellations

Your rights regarding cancellations, change-of-mind returns, faulty products, damaged products, incorrect items and refunds are explained in our Refund & Returns Policy.

Nothing in these terms or our other policies limits any statutory rights that cannot legally be excluded.

12. Damaged, Missing or Incorrect Products

Please inspect your order after delivery.

If something is damaged, leaking, missing or incorrect, please contact us as soon as reasonably possible.

We may request photographs or other information reasonably necessary to investigate the issue.

Please retain the affected product and packaging while an investigation is ongoing.

Further information is available in our Refund & Returns Policy and Shipping & Delivery Policy.

13. Resale & Commercial Purchasing

Our website is primarily intended for customers purchasing products for personal use unless otherwise agreed with HAMYNAT.

If you wish to purchase unusually large quantities or purchase products for commercial resale, please contact us.

We reserve the right to limit quantities or decline orders where we reasonably believe an order is being placed for unauthorised commercial resale or in circumstances that could interfere with product availability for ordinary customers.

14. Fraud, Abuse & Misuse

We reserve the right to take reasonable steps to protect HAMYNAT and our customers against fraud, payment abuse and misuse of our website.

This may include reviewing or declining suspicious transactions, limiting orders, requesting additional information where appropriate, or restricting accounts where we reasonably believe fraudulent or abusive activity has occurred.

This may include repeated claims or activity where there is reasonable evidence suggesting misuse.

Any action we take will be proportionate to the circumstances and will not affect legitimate statutory consumer rights.

15. Website Use

You must not knowingly misuse our website, attempt to gain unauthorised access to it, introduce malicious software, interfere with its operation or use it for unlawful or fraudulent purposes.

Content on the HAMYNAT website, including our own branding, graphics, photographs, text and designs, may be protected by intellectual-property rights.

You may not reproduce or commercially exploit HAMYNAT-owned content without permission.

Third-party brand names, trademarks and product imagery remain the property of their respective owners.

16. Third-Party Brands

HAMYNAT may sell products manufactured by third-party brands.

References to those brands are used to identify the genuine products being offered for sale and do not necessarily imply that HAMYNAT is affiliated with, sponsored by or officially endorsed by the manufacturer unless expressly stated.

All third-party trademarks and brand names remain the property of their respective owners.

17. Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful.

In particular, nothing excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any consumer rights that cannot legally be excluded.

HAMYNAT is not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses resulting from circumstances for which we are not legally responsible.

If you are purchasing as a consumer, we do not exclude liability that we are legally required to accept under consumer law.

18. Events Outside Our Reasonable Control

Occasionally, our ability to process or deliver orders may be affected by circumstances outside our reasonable control, such as severe weather, transport disruption, carrier network problems, industrial action, major technology failures or other exceptional events.

Where this occurs, we will take reasonable steps to minimise disruption and will continue to honour any rights you have under applicable consumer law.

19. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes to our business, website, services or applicable law.

The terms applicable to your purchase will generally be those in effect when you place your order.

20. Governing Law

These terms are governed by the applicable laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you may also benefit from mandatory consumer protections and rights to bring proceedings available under the laws applicable where you live.

21. Complaints & Contact

If you have a problem with an order or our service, please contact HAMYNAT using the contact information provided on our website.

We would always prefer the opportunity to investigate and resolve a problem directly with you.

22. Your Statutory Rights

Nothing in these Terms of Service, our Refund & Returns Policy or our Shipping & Delivery Policy is intended to exclude, restrict or replace your statutory consumer rights.
